Terms & Conditions

  • These terms of usage (“Terms”) govern your use of the Website and Services provided therein (“Services”). By using or visiting the Website, or by using any content or information provided as part of the Website/ Services, you shall be deemed to have read, understood, and accepted to be bound by these Terms. If you do not agree to these Terms, do not use this Website/ Services. Because these Terms are a legal contract between you and Sulhaa Healthcare, it is important that you review the Terms carefully before accessing or using the Website. These Terms are not intended to alter in any way or limit the terms or conditions of any other agreement that you may have with Sulhaa Healthcare.

 

  • If you are not an individual and are an incorporated/registered entity/institute/organization seeking to avail the services of The Mind Garden for your members/employees/students or any individuals registered with you for any services, you shall enter into an agreement/memorandum of understanding with The Mind Garden for this purpose. Each individual availing the services of The Mind Garden under such agreement/memorandum of understanding shall be bound by these Terms and Privacy Policy available here.

 

  • ​We reserve the right to make changes to these Terms at any time. Any such modifications will become effective immediately upon posting to the Website and your continued use of the Website, and/or the Services constitutes your agreement to such modifications. You agree to periodically review the current version of these Terms of Use as posted on the Website.

 

  • Use of the Website is available only to persons over the age of eighteen (18). If you are a minor i.e. under the age of eighteen (18) years, you shall not register as a member of the Website and shall not sell or purchase any items on the Website, unless you are accessing this Website with parental guidance or guidance of a legal guardian. We reserve the right to terminate your membership and refuse to provide you with access to the Website if it is brought to our notice or if it is discovered that you are under the age of eighteen (18) years and are accessing this Website without parental consent and guidance or consent and guidance of a legal guardian. We will not be liable for any harm caused to you on account of any use of the Website without appropriate parental consent.

 

24-Hours Cancellation/Rescheduling Policy

  1. Cancellation of session(s) by the client shall be entertained and subjected to full refund/rescheduling ONLY UNTIL 24 HOURS PRIOR to the scheduled session time.

  2. Intimation by the client must be made to the PR team of the company within the said time period.

  3. Any cancellations made after said time period shall be considered as ‘no-show’ and NO refund would be made to the client.

  4. Extension of a session up to 10 mins may be considered, post which full fees for an additional session shall be charged.

  5. In case of cancellation by the Consultant / Professional,  the client shall be intimated well in time, and the session shall be rescheduled with immediate effect with no additional charges.

 

Referrals

 

The client(s) shall be referred to the appropriate professional based on a) concern/problem suitability, b) availability in professionals’ schedule, c) fee preference. 

 

*Note: All communication between the professional and client(s) shall happen through the company representative; sharing of personal contact information of professional is not permissible.  

 

Teletherapy and Limitations

 

Teletherapy refers to therapy/consultation sessions conducted on an online platform (audio/video). Teletherapy is limited in its confidentiality scope and is subjected to human error. Technological interaction and record keeping may lead to:

 

  1. Leaking of information to third-party/mediators

  2. Hacking of information by third-party/mediators

  3. Loss of information

*Note:The company shall attempt its best to contain these limitations, but is not liable to legal charges for the same. 


 

Confidentiality Agreement

 

The laws under Mental Healthcare Act 2017, mandating confidentiality concerns shall be liable to all professionals. For the purpose of maintaining professionalism and confidentiality, establishment of informal relationships between the client and professional is strongly discouraged. 

 

The information and details shared in the session shall be kept confidential, including post termination of the session. The client is expected to use a secure connection for the consultation, in a relatively quiet and private space.

 

The information shall not be shared with third parties unless mandated by law or in case of:

  1. If the client is identified to be a danger to themselves and/or others.

  2. If the law requires reporting of the case to authorities.

  3. If required for any governmental body assistance.

  4. For minor clients, information may be shared with parent/guardian, with/without their consent.


 

Record Keeping

 

The records (case history, consultant/therapist notes, recordings, media shared) shall be kept confidential as per the policies of the company. Records shall be destroyed after 2 years of termination of official sessions.


 

Client’s Rights

  1. The client may request a particular professional for a therapy session.

  2. The client may leave the session at any point before/during the session. (See cancellation and rescheduling policy below)

  3. The client may request access to the consultant/professional’s notes*.

  4. The client may choose to withhold information that they don’t wish to share with the consultant/professional.

  5. The client may request details of the referred professional (including educational qualifications and certifications).

  6. The client may request a change of consultant/professional, upholding the rescheduling policy with the understanding that the request may not necessarily be feasible to be fulfilled.

  7. The client may choose to terminate the therapeutic alliance with due adherence to the cancellation policy.

  8. The client may like to provide feedback for the consultant / professional for providing better services.

*NOTE: Except in case of clinical details deemed harmful by the professional, in which case, the details may be shared with guardian/parent after informing the client. 


 

Misc Legalities

 

  1. Emotional, sexual, physical, mental abuse/harassment by a) any person working for Sulhaa Healthcare LLP, b) professional/therapist, c) client/ any person related to client, must be reported to company authorities.

  2. Any instance of harassment or abuse will be reported to concerned legal authorities.

  3. In case of minors, any instance of harassment or abuse shall be reported following the guidelines under POCSO Act *

*NOTE: Reporting of abuse/harassment cases for minors may be done with/without their consent.
